Document with which a person empowers another person to carry out one or several acts on his behalf. Or in general, it entrusts the management or administration of any of its affairs, representing it before public or private entities in Guatemala.
A mandate may be:
- Special or general: according to the powers delegated.
- Free or onerous: according to the remuneration.
- With representation: the agent acts on behalf of the principal. The responsibility for the acts executed corresponds to both of them.
- Without representation: The agent acts in his own name
- Judicial: for representation in court
- Extra-judicial: For representation in any matter.
- Express acceptance: the agent accepts in the document the powers conferred.
- Tacit acceptance: the appointed agent, without accepting in the document, executes the actions entrusted to him/her in the mandate.
A document, less formal than a mandate, by which a person authorizes another person to perform certain acts on his behalf. The signature of the person or persons appearing must be authenticated by a notary public.
The notary attests that a signature or a document is authentic because:
- The signature has been placed in his presence by the person requiring his services;
- The documents presented to him are authentic, because they were reproduced from the respective originals, and he must confirm this.
Advice and assistance in Switzerland and in Guatemala in the processing of the different matters that are handled extrajudicially and their implications in any type of registry of the country. Such as

Authorization of contracts of any nature that must have legal effects in Guatemala. By means of the written contract, the notary gives form to the will of two or more persons with legal capacity, regulating the conditions, relations and obligations of both parties.
Prior authorization of compliance with the requirements established by law. The legal union through the legal bond of marriage between Guatemalans or Guatemalans with foreigners, to be registered in Guatemala.
To confer by means of the granting of a Mandate, the faculties that according to the law are necessary to process in the voluntary or litigious way a divorce in Guatemala.
Authorize and register before the National Registry of Persons (RENAP) and before any other entity in Guatemala, the identification of a person. The identification of a person is understood as the legal procedure followed to register the names with which a person is constantly and publicly identified in social and family relations and which are different from those with which he/she was registered at birth.
Authorizing notarial acts. The notarial act is the original public instrument in which the notary, at the request of the interested party, relates, in order to record under his faith, one or several facts that he witnesses or that are known to him. They are authorized with his signature and seal.
Formalization of a declaration made under oath by a person. With this public document, the notary who authorizes the act warns the declarant that he/she is swearing before the law and warns him/her of the penalties that the criminal law regulates for the crime of perjury.
